I couldn't kill anyone over some possessions.
I have looked down the business end of a pistol several times before. The person who did it was just wanting to get away. The only thing I felt was revulsion and fear and wanting them to get away from me, not the urge to kill.

I think intent would be obvious within a very short moment. It's a rare instance when both parties are going to stand there and state at each other and go, duh, whats going down?
I understand your point but it's rather a remote possibility for someone not to know what immediate intentions are.
And again I'll say, if the criminal is showing any aggression whatsoever then yes I wouldn't blame anyone at that point for blasting away.
